  Abstract:  The commentary to the canons 276–278 of the Codex Canonum Orientalium Ecclesiarum. The new legislation concerning the position of the proptopresbyter is founded on the increasingly diversed pastoral facts as well as the dynamics of diocesan territorial administration. The legislator considered appropriate to regulate it in simply three canons to avoid creating an excessive number of duties for the position of protopresbyter. Must of the these resposabilities are subdiarily transferred to the particular law of each Church sui iuris. The specified canons provide only a general framework. The diocesan bishop remains central in the ordination and relegation of the protopresbyter. Nevertheless it is not a discretionary action but rather a decision made after a preliminary consulting of the clergy from the specific territorial area. This decision is juridically configured according to the needs of the pastoral activity and to the advice of a body that represents the entire diocesan clergy, an advice the bishop cannot ignore.
