  Abstract:  La pena di morte come sanzione giuridica alla luce delle tre teoreme della punizione. La vita è in se stessa un valore che si deve riconoscere come tale ad ogni individuo; la Dichiarazione universale dei diritti dell’uomo afferma infatti nel suo terzo articolo che “Qualsiasi essere umano ha il diritto alla vita, alla liberta ed alla sua sicurezza”. In chiave di interpretazione cristiana soltanto Dio è il datore di vita, dunque padrone della vita e della morte. Il quinto comandamento afferma, sottolineando questa realtà inequivocabile Non uccidere.
