Abstract: The text is a short commentary on Decision no. 43/2021 of the Romanian High Court of Cassation and Justice – Panel on clarifying certain legal matters, by which the supreme court ruled that the letter of guarantee issued by a credit institution is an enforceable title only if it is issued to guarantee a credit agreement.
