  Abstract:  Gândirea juridică de drept civil nu se confundă cu doctrina, deşi îi seamănă; ea se caracterizează printr-un sistem de ansamblu, o noutate de idei şi o personalitate puternică. A fost extrem de strălucitoare şi continuă secolele precedente, dar cu rupturi: ataşamentul la libertate, un scepticism amestecat cu pesimism şi o limbă clară şi elegantă. A suferit influenţa marilor curente filozofice, în general cu întârziere; de exemplu Bergson, Kant şi Freud. A dominat ororile secolului, fără a căuta prea mult să-I înţeleagă bulversarea – mai ales morală – pe care a dezaprobat-o. Autorul reţine, cu subiectivism, cinci nume: Marcel Planiol, Raymond Saleilles, François Gény, Georges Ripert şi dl. Jean Carbonnier.
