  Abstract:  Children Protection by the State Through the Family Allowances System: An Encroached Right. This analysis focuses on the constitutional right of the children and the young to be protected by the state through various dimensions and types of social policies concerning the family. The theoretical framework of this study is based on an overview of the main transformations occurred in the social dimensions of the family concept and the reflection of such transformation in the different family related policies promoted by the European states, especially in the South-European social policy model. The first direction of the analysis follows the legal framework of children protection by the state in Romania through the family allowances system, attempting to asses the extent to which this system is fulfilling its goals of promoting equality among and protection of the children. The second direction of analysis concentrates on the European Union recommendations and requirements from the member states regarding the effectiveness of their child protection aimed social policies. The third analysis direction is focused on the South European social policy model and its family allowances type of system, applied in Italy, Spain, Portugal and Greece, exploring its proximity with the European Union standards and the possibility of adopting and adapting it to the Romanian case.
