In this article, I analyzed the ECHR judgment of Tusă v. Romania from various possible perspectives: the perspective of the Romanian state, the perspective of the applicant and the perspective of the European Court. Thus, I examined the facts and the legal issues, pointing out the relevant problems regarding the right to an effective procedure in the context of medical negligence.
