  Abstract:  En matière de la sûreté personnelle, le cautionnement est toujours la sûreté personnelle par excellence et pratiquement unique en droit chinois. Pour les autres sûretés personnelles, innommées (la garantie autonome et la lettre d’intention), la pratique chinoise a une position très prudente : elle n’a reconnu que la garantie autonome internationale. Si les nouvelles sûretés personnelles ont déjà trouvé leur place dans le Code civil français, elles pourraient aussi, selon nous, s’intégrer sans problème au droit chinois.
