  Abstract:  La réserve contractuelle potestative – un possible succédanépour la notion de la condition potestative. Les réserves contractuelles illustrent une hypothèse de la formation progressive du consentement au contrat final; lorsqu’une personne émet une offre assortie de réserves, elle laisse planer un doute sur sa volonté de s’engager. Une telle offre présenterait un caractère potestatif en ce que son émetteur prétendrait vouloir contracter et lier le destinataire de l’offre en cas d’acceptation de celle-ci, tout en conservant la possibilité de se dérober à son propre engagement (a) ou de modifier essentiellement sa portée (b).
