  Abstract:  L’exception d’illégalité dans le contentieux administratif et ses conséquences sur la responsabilité civile. Le contentieux financier relève un tas des problèmes en ce qui concerne la responsabilité civile des personnes phisiques. Cette responsablité ne pourra pas être angajée si ses conditions ne sont pas reunies; la solution subsiste même dans l’hypothèse du rejet de l’exception d’illégalité et même si on constat des manquements à la discipline finacière. Les modifications concernant la compétence mat matérielle apportées par les dernières modifications constitutionelles (art. 140 &1 et 155 pct. 6) n’enlève du tout l’actualité de cette discussion.
