  Abstract:  Cette étude veut rechercher la qualification du droit de la personne expropriée de demander à l’administration la rétrocession du bien passé dans le domaine public, ainsi comme il est prévu par l’art. 35 de la Loi 33/1994 sur l’expropriation pour cause d’utilité publique. Après un détour rétrospectif de l’institution, en dévoilant son mécanisme et en la comparant avec quelques notions de droit privé, l’auteur conclue que, le droit de rétrocession soit de nature potestative. La qualification, au-delà de sa signification intellectuelle d’appartenir à une catégorie juridique en vogue, a des importantes conséquences pratiques (spécialement du point de vue de la prescription).
