  Abstract:   Causes which exclude sau diminish the person’s discernment (psychiatric defences) in common law: the approach of criminal law. The main purpose of the present study constitutes the brief analysis of psychiatric defences in criminal law. Throughout this scientific research the psychiatric defences have been presented such as: irresponsibility; diminished responsibility; intoxication and automatism. Several cases form precedent law were analyzed. As a result, some important conclusion have been formulated.
