Abstract:  The Interpretation Of The Member States'' National Legislations In Accordance With The EU Directives. The paper at hand aims at revealing the fundamental importance of the doctrine of consistent interpretation as a judicial protection legal device, in the broader context of the legal effects produced by EC directives, and with reference to the relevant judgments issued by the European Court of Justice. In time, the status of the doctrine of consistent interpretation has considerably changed in the sense of strengthening its position in the context of the above mentioned effects of the EC directives. It has to be acknowledged that this progress occurred due mainly to the specific approach to the issue, taken by the European Court of Justice. Thus, as a mode of giving effect to the Community law before the national authorities of the Member States, as we will see, the doctrine of consistent interpretation takes precedence over direct effect. However, as it was provided in the doctrine, the scope of the interpretive obligation remains somehow uncertain, partly because this technique functions to resolve conflicts between incompatible norms. To this end, the legal uncertainty thus created could be reduced through more extensive reasoning judgments of the ECJ and through bringing the conditions of the doctrine’s application in line with direct effect. However, the doctrine of harmonious interpretation has exemplified outstandingly that the binding effect of directives reaches further than the mere obligation of implementation: the obligation to achieve the result envisaged by the directive is binding on all national authorities, including the courts, and not only on those responsible for the implementation. Thus, the doctrine of consistent interpretation brings about a considerable contribution at ensuring the consistency, coherence and uniform application of the EU law within the Member States.
