  Abstract:  Prin sentinţa penală nr. 679 din 28 mai 2002, Judecătoria CIuj-Napoca a dispus: Admite în baza art. 278 C. pr. pen şi art. 21 din Constituţie plângerea formulată de Banca B. împotriva rezoluţiei nr. 785/P/1999 din 15.03.2000 a Parchetului de pe lângă Tribunalul Cluj prin care s-a dispus scoaterea de sub urmărire penală a învinuiţilor P.V., D.I., P.M.R., C.A., C.M.M, G.C.L., G.M. pentru săvârşirea infracţiunilor de abuz în serviciu contra intereselor persoanelor prevăzută de art. 246 Cod penal, de folosirea creditelor societăţii în scop contrar intereselor acesteia prevăzută de art. 194 pct. 5 din Legea nr. 31/1990 şi de înşelăciune prevăzută de art. 215 alin. 3 Cod penal, şi împotriva rezoluţiei nr. 473/II/2000 a Parchetului de pe lângă Curtea de apel Cluj.
